Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the BakeFrame platform operated by BakeFrame (“we”, “our”, “us”) at bakeframe.art. By creating an account or using the service you agree to these Terms.
1. The Service
BakeFrame provides a web-based AI filmmaking platform that integrates with third-party AI providers (text, image, video, audio) and cloud storage services via a Bring-Your-Own-Key (BYOK) and Bring-Your-Own-Storage (BYOS) architecture. We provide orchestration, creative tools, and a production workflow — we do not host or operate the underlying AI models.
The marketing site may collect name, email, and contact information via demo request and waitlist forms. By submitting such a form, you consent to us contacting you about BakeFrame. See our Privacy Policy for full details on how that data is handled.
2. Eligibility
You must be at least 13 years old (or 16 in the European Economic Area) to use BakeFrame. By using the service, you represent that you meet this requirement. Organizations using BakeFrame represent that the individual accepting these Terms has authority to bind the organization.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@bakeframe.art if you suspect unauthorized access.
You may not create accounts using automated means, share accounts across multiple users without an appropriate plan, or create accounts to circumvent suspension or termination.
4. BYOK — Your API Keys
BakeFrame does not provide AI model access. To use AI-powered features, you must supply your own API credentials from providers such as OpenAI, Anthropic, xAI, Google Gemini, Runway, Luma AI, or ElevenLabs (“Third-Party Providers”).
By adding API keys, you confirm that: (a) you have the right to use those credentials under the relevant provider's terms; (b) all usage and associated costs for those keys are your responsibility; and (c) you will comply with each provider's acceptable use policy. BakeFrame is not liable for charges, rate limit violations, or policy breaches with Third-Party Providers.
Your API keys are encrypted at rest (AES-256-GCM) and used solely to proxy requests you initiate. We do not use your keys for any purpose other than fulfilling your requests.
5. BYOS — Your Storage
When you configure Bring-Your-Own-Storage, all generated media (video, images, audio) is written directly to storage you control (AWS S3, Azure Blob, Cloudflare R2, GCS, etc.). You are responsible for your storage bucket's access controls, costs, and compliance with applicable laws, including any data residency requirements.
6. Your Content & Ownership
You retain all intellectual property rights in the content you create using BakeFrame — scripts, characters, storyboards, and generated media. You grant BakeFrame a limited, non-exclusive license to process your content solely as necessary to provide the service.
You are solely responsible for ensuring that your content and your use of Third-Party Provider outputs complies with applicable laws and the terms of those providers. You must not use BakeFrame to generate content that is unlawful, harmful, abusive, defamatory, obscene, or that infringes third-party intellectual property rights.
7. Acceptable Use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract source code from the platform
- Use the service to generate CSAM or content that sexualizes minors
- Attempt to circumvent authentication, rate limits, or access controls
- Use automated scripts to scrape, crawl, or bulk-generate content in violation of applicable provider terms
- Resell or sublicense access to BakeFrame without written permission
- Use the service in any way that violates applicable laws or regulations
We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.
8. Fees and Payment
BakeFrame offers a free tier and paid subscription plans. Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except where required by law or as otherwise stated at the time of purchase.
We may change pricing with 30 days' notice for existing subscribers. Continued use after the effective date constitutes acceptance of the new pricing.
9. Availability and Changes
We aim for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features with reasonable notice. We will provide at least 30 days' notice before discontinuing the service entirely.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED OUTPUTS WILL BE ACCURATE, COMPLETE, OR FREE OF ERRORS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BAKEFRAME AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNTS YOU PAID TO BAKEFRAME IN THE TWELVE MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold BakeFrame harmless from any claims, losses, damages, and expenses (including reasonable legal fees) arising from: (a) your use of the service; (b) your content; (c) your breach of these Terms; or (d) your violation of any third-party rights or applicable law.
13. Termination
You may close your account at any time from Settings. We may suspend or terminate your account for violation of these Terms, non-payment, or if required by law. Upon termination, your right to use the service ceases immediately. We will retain your data for 30 days after termination before deletion, during which time you may export it.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes will be resolved through binding arbitration in accordance with the AAA Commercial Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction for IP violations.
15. Changes to These Terms
We may update these Terms as the service evolves. Material changes will be notified via email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
